Novus International, Inc. (“Novus,” “we,” “us,” or “our”) is committed to protecting your privacy.  Novus has prepared this Privacy Statement (this “Privacy Statement”) to describe how we collect, process, use, and disclose information relating to you as an individual or as a business (“Personal Data”). The Personal Data we collect depends on the interactions you have with us, including the products and services you use, your location, and applicable law. This Privacy Statement also applies to subsidiaries and affiliates of Novus that link to this Privacy Statement, each of which are a data controller. In some circumstances, we may provide you with specific data privacy information (a “Specific Statement”) in addition to this Privacy Statement, depending on the specific interactions you have with us. If the Specific Statement and this Privacy Statement conflict, the Specific Statement will prevail unless stated otherwise. While we use the term “Personal Data” throughout this Privacy Statement, we intend for that term to encompass “Personal Information,” where that term is used by laws that are applicable to Novus.

Novus reserves the right, at any time, to modify this Privacy Statement.  If Novus makes revisions that change the way we collect, use, or share personal information within the scope of this Privacy Statement, we will post those changes in this Privacy Statement.  You should review this Privacy Statement periodically so that You keep up to date on our most current policies and practices.  We will note the date when our Privacy Statement was last updated at the beginning of this Privacy Statement. If we make a material change to our Privacy Statement, we may endeavor to provide you with more direct notice, such as through notification or communication.

Personal Data Collection

Personal Data is information that identifies, describes, or is reasonable capable of being associated with a person or household. This includes information such as or connected with your name, and may include things such as your email address, physical address, telephone number or certain device information when it is individually identifiable or connected to individually identifiable information.

We collect Personal Data when you interact with us such as when you provide it to us directly, automatically, and from third parties.  For example, you may choose to submit personal information to Novus when you complete online forms, use or access content, request services, or register for an event through our website. We may collect the following types of Personal Data from you through the methods described above depending on your interactions with us:

  • Contact Information, including your name, email, phone number, company, industry and address. If you purchase our products through a distributor or wholesaler, we will also collect the name and address of the distributor or wholesaler who you purchased our products or services through.
  • Demographic Information, such as your job title, employer, gender, citizenship, and country of residence.
  • Financial/Payment Information, such as your billing address, shipping address, bank account information, credit card information, and payment transaction and verification information.
  • Analytical Information, such as information about your visit to our website, including pages and products you view on our website, ads that you clicked on, emails from us that you opened, browser type, operating system, Internet Protocol (“IP”) address, and device and general geolocation information.
  • Commercial Information, such as the products and services you purchase from us, preferences regarding our product lines, and geographic region.
  • Unique Device Information, such as your operating system, identifiers we associate with your device(s) that visit our website, including through cookies, web beacons, pixel tags, and similar technology.
  • Audio, Electronic, Visual, and Similar Information, such as call and video recordings.
  • Inferences, including inferences about you that we draw from other Personal Data we collect.

If you voluntarily provide us with any other type of Personal Data not indicated above, we will also collect and process that information.

As mentioned above, we may collect Personal Data about you from a third party, including our affiliates. If you submit any Personal Data about another individual to us, you are responsible for ensuring that you have their authority to disclose the information to us and for us to use the Personal Data we collect about them from you in accordance with this Privacy Statement. We also collect Personal Data from third parties when:

  • You attend a trade show or event where we are a sponsor or participant, and the event organizer shares your contact information or demographic information with us as a benefit of our sponsorship or participation.
  • You choose to participate in certain third-party applications or features, such as interacting with us on our social media pages or similar features on third-party websites, and they forward your Personal Data on to us.

We are not responsible for these third parties’ dissemination of your Personal Data. Unless we disclose to you otherwise, the terms of this Privacy Statement will apply to all Personal Data we collect from third parties.

Personal Data Use

Novus’ primary purpose in collecting Personal Data is to provide you with information regarding products and services offered by Novus, including its parent, subsidiaries, trusted affiliates and other related companies, independent contractors, and business partners.  Novus may also use personal information for various purposes depending on your interactions with us and as permitted by applicable law, as follows:

  • Provide our Products and Services – We use your Contact Information, Demographic Information, Financial/Payment Information, and Commercial Information to provide you with products and services you purchase from us, process or fulfill orders and transactions, maintain and service your account, process payments, communicate with you about your order.
  • Customer Service – We use your Contact Information, Demographic Information, and Audio, Electronic, Visual, and Similar Information to provide you with customer service, respond to your inquiries, and assist you when you request assistance or contact us.
  • Marketing – We use your Contact Information, Demographic Information, Commercial Information, Analytical Information, Unique Device Information, and Inferences to market products and services to you, including to target products and services that we believe may be of interest to you based on your prior interactions with us or other third parties, to send you marketing communications, and for market research about the effectiveness of and your satisfaction with our products and services.
  • Analytics – When you interact with us in certain capacities (such as, when you visit our website) and where permitted by applicable law, we automatically collect and use Analytical Information and Unique Device Information to continually improve your experience with our services, to customize our products and services to your preferences, and to monitor our website usage and performance.
  • Business Purposes – We may use any of the categories of Personal Data we collect from you for our internal business purposes, in accordance with applicable law, including to protect and secure our website, to defend ourselves in legal proceedings, to enforce and defend our contracts, policies and terms, to facilitate the functionality of our website and services, including to debug, identify, and repair efforts that impair functionality, to maintain our property and our records, and to undertake quality and safety assurance measures.
  • New Product Development – We use your Commercial Information, Contact Information, and Demographic Information to refine and develop new products based on feedback you share with us related to products and services you purchase, and based on market research we conduct.

As described above in the “Marketing” and “Analytics” items, Novus participates in behavioral based advertising and retargeting on our website.  This means that a third party may use technology (e.g., a cookie) to collect Personal Data about your use of our website so that they can provide advertising about products and services tailored to your interests.  This advertising may appear on our website, or on other sites. We may also use your Personal Data as otherwise set forth in a Specific Notice, as you direct us to, or as you otherwise consent to.

Legal Bases for the Processing of Personal Data

We rely on the following legal grounds for the collection, processing, and use of your Personal Data:

  • Contract: the processing is necessary to provide the products or services as requested by you or for the performance of a contract to which you are a party (or to take steps at your request prior to entering into a contract).
  • Consent: the processing is based on your consent for one or more purposes (e.g., marketing).
  • Legal Obligation: the processing is necessary for compliance with our legal obligations (e.g., complying with law or subpoenas).
  • Legitimate Interest: the processing is necessary for the purposes of our legitimate interests or those of a third party (e.g., improving your experience with our websites and products), except where overridden by your fundamental rights and freedoms that would require protection.

In general, providing us with your Personal Data is voluntary, but in certain cases it is necessary in order to enter into a contract with us or to receive products or services you request from us.

Personal Data Disclosure to Third Parties

Novus may disclose Personal Data we collect for the following purposes and to the following categories of parties, depending on how you interact with us. Novus has made the following disclosures in the last twelve months:

  • Novus Companies. Personal Data collected from Users and disclosed to a parent, subsidiary, and other related companies and its trusted affiliates, independent contractors, channel partners, agencies, and business partners. We disclose the following categories of Personal Data to Novus Companies:
    • Contact Information, Demographic Information, Financial/Payment Information, Analytical Information, Commercial Information, Unique Device Information, Audio, Electronic, Visual, and Similar Information, and Inferences.
  • Suppliers, Contractors, and Distributors. In limited circumstances, we may disclose your Personal Data to our suppliers, contractors, and agents who perform functions on our behalf, or in connection with services offered by Novus or to meet a request you make. We disclose the following categories of Personal Data to Suppliers, Contractors, and Distributors:
    • Contact Information, Demographic Information, Financial/Payment Information, Commercial Information, and Inferences.
  • Service Providers. Novus relies on service providers, vendors, and contractors to perform services on our behalf to help us operate our business. When we disclose Personal Data to these individuals, they are obligated to only use your Personal Data for the limited purpose of providing services to us. We disclose the following categories of Personal Data to Service Providers:
    • Contact Information, Demographic Information, Financial/Payment Information, Analytical Information, Commercial Information, Unique Device Information, Audio, Electronic, Visual, and Similar Information, and Inferences.
  • External Marketing, Advertising, and Social Networks. Where permitted under applicable law and subject to rights you exercise or preferences you express (as applicable), we disclose your Personal Data to external marketing entities and agencies, social networks, and advertising networks to assist us with our marketing efforts and to reach a broader audience who may be interested in our content, products, and services. These entities help us refine our marketing efforts and assist with our targeting of advertisements to you. We disclose the following categories of Personal Data to External Marketing, Advertising, and Social Networks:
    • Contact Information, Demographic Information, Analytical Information, Commercial Information, Unique Device Information, Audio, and Inferences.
  • As Required or Appropriate under the Law. There may be instances when Novus may disclose Personal Data without providing you with a choice in order to: (1) protect the legal rights of Novus; (2) protect the safety and security of other Users; (3) protect against fraud or for risk management purposes; or comply with the law or legal process.
  • Business Transfers. If Novus sells all or part of its business, makes a sale or transfer of assets or is otherwise involved in a merger or business transfer, Novus may transfer your Personal Data to a third party as part of that transaction. We may share any or all of the categories of Personal Data we have collected from or about you in this instance. We also share certain information with our investors, and our investors may have access to some categories of Personal Data we collect from or about you.

We may share aggregated data or deidentified data that has been anonymized, pseudonymized or de-identified (so that you are not identifiable) with third parties – such as publishers, advertisers or connected websites – and may make this data publicly available or use it for any purpose.

We may also disclose your Personal Data as otherwise set forth in a Specific Notice, as you direct us to, or as you otherwise consent to.

Links to Social Networking and other Third-Party Websites

Our website or services may contain links to social networking and other websites and mobile applications that are operated and controlled by third parties. While we try to link only to websites that share our high standards and respect for privacy, we do not take responsibility for the content, or the privacy practices employed by other websites. Unless otherwise stated, any Personal Data you provide to any such third-party website will be collected by that party and not by us, and will be subject to that party’s privacy policy (if any), rather than this Privacy Statement. In such a situation, we will have no control over, and shall not be responsible for, that party’s use of the Personal Data you provide to them.

International Data Flow

Novus is based, and our website is hosted, in the United States of America.  If you are from a country outside of the United States of America, the laws governing data collection and use in the jurisdiction in which you reside may differ from U.S. law. Generally, your Personal Data is stored in your home jurisdiction. However, many of our affiliated entities, trusted third-party service providers, event co-sponsors, marketing and other business partners are located in other jurisdictions, including in the United States, and in some instances, your Personal Data may be transferred to or processed by Novus and its agents jurisdictions other than your own.  To that end, please note that any Personal Data that you provide to Novus could be transferred to another jurisdiction, including the United States of America.  By providing your Personal Data to us or by visiting our website, you hereby specifically and expressly consent to such transfer and processing, and the uses and disclosures set forth in this Privacy Statement.

Rights and Choices

Depending on where you reside and applicable law, you may have certain rights and choices regarding our processing of your Personal Data, as described below. To exercise these rights, please contact us using the information listed in the “Contact Us” section of this Privacy Statement.

  • Right to Access and Know. You may have the right to request that we disclose information to you about our collection and use of your Personal Data, and specifically, to request the following:
    • The categories of personal information we collected about you,
    • The specific pieces of personal information we collected about you,
    • The categories of sources for the personal information we collected about you,
    • The business or commercial purpose for collecting your personal information,
    • The categories of third parties with whom we have disclosed your personal information in the preceding twelve months, and
    • The categories of personal information we sold or shared about you, and the categories of third parties to whom the personal information was sold or shared by category of personal information.

This right may be subject to time limitations, such as, to information we have processed about you in the last twelve months.

  • Right to Update and Correct. If your Personal Data is inaccurate or if you would like to update your Personal Data, you may have the right to update and correct the Personal Data so that it is accurate and up to date. You may also have the right to complete your Personal Data where it is incomplete by providing supplementary information.
  • Right to Portability. After you make a request to access or know your Personal Data, you have the right to request to obtain a copy of this information in a portable, readily usable format that allows you to transmit the information to another party, to the extent it is technically feasible. You may also have the right to request that we transfer your data to another organization, under certain circumstances. This right may be subject to technical limitations and feasibility. We also reserve the right to charge a reasonable fee based on administrative costs for additional copies of your Personal Data. If we plan to charge a fee, we will notify you before we proceed with your request.
  • Right to Deletion or Erasure. You may have the right to request that we delete any of the Personal Data that we collect or retain about you, subject to certain exceptions. After we receive and verify your request, we will delete (and direct any of our service providers that hold your Personal Data on our behalf to delete) your Personal Data from our records, unless an exception applies. We may deny your deletion request if retaining your Personal Data is necessary for us or our service providers, as permitted by law.
  • Right to Object to or Restrict Certain Processing. You may have the right to restrict certain processing of your Personal Data, or to object to certain processing of your Personal Data, including where our legal basis for the processing is your consent, where the processing involves Special Category Personal Data or Sensitive Personal Data, or where it involves automated decision-making technologies. This right is subject to certain restrictions.
  • Right to Withdraw Consent or Opt-Out. If you have previously consented to the use of your Personal Data for direct marketing or targeted marketing, you may withdraw your consent at any time. You may also have the right to opt-out of the sale of certain types of Personal Data under applicable law.   • Right to Limit Certain Uses and Disclosures of your “Sensitive Personal Data.” If we collect “Sensitive Personal Data” or “Special Category Personal Data” (as those terms are defined in applicable statutes) from you, you have the right to limit our use and disclosure where we have collected it to use which is necessary to perform the services or provide the goods reasonably expected by you, and as otherwise authorized by the statute and regulations. We believe we only use your Sensitive Personal Data in ways that you would reasonably expect are necessary to perform the services or to provide you with the goods you request.   • Right to Lodge a Complaint. You may have the right to make a complaint with the supervisory authority for your country of residence. If you are a resident of the European Economic Area (EEA), more details can be found here.
  • Right to Appeal. If you are a resident of certain jurisdictions, you may have the right to file an appeal with us if we deny your request to exercise your rights. Requests to appeal can be communicated through the same means by which your request was submitted. If we deny your appeal, you may have the right to appeal to the regulator in your jurisdiction. We will provide you the information of the applicable regulator if we deny your appeal.
  • Additional Rights. In addition to the above rights, you may also have the right to:
    • Appoint an individual to exercise your rights on your behalf, and
    • Access information about automated decision making (as applicable).

To not be discriminated against for exercising your rights. Personal Data Retention

Novus retains your personal information for as long as reasonably necessary in light of the purpose for which it was collected, consistent with Novus’s data retention policies and procedures. Once your relationship with us ends, we will delete or anonymize our Personal Data in accordance with our data retention policy, unless a statutory retention requirement applies.

Security of Personal Data

We use reasonable technical and organizational measures to help prevent Personal Data from becoming disclosed to individuals who are not described in this Privacy Statement.  While Novus attempts to protect the Personal Data in our possession, no security system is perfect, and Novus cannot promise that information about You will remain secure in all circumstances. If you have reason to believe that your interaction with us is no longer secure (e.g., if you feel that the security of any account you might have with us has been compromised), please immediately notify us by emailing privacy@novusint.com.

Additional Information and Specific Notices

Other Contractual Relationships.  If you enter into a separate contractual relationship with Novus which requires, or contemplates, collecting, using, or sharing information about you in a manner that is different than that which is described in this Privacy Statement, the terms of that agreement, or Specific Statement, will apply.

Cookies. As described throughout this Privacy Statement, we use “cookies,” a small text file transferred to your device, along with similar technologies (e.g., pixel tags and internet tag technologies, web beacons and embedded scripts) to help provide you with a better, more personalized user experience. Children. Our website does not permit children under 13 years of age to become users, and we do not intentionally collect information from children, in accordance with the Children’s Online Privacy Protection Act, 15 U.S.C., §§ 6501-06. By using our website, you represent that you are 13 years of age or older.

Notice to Employment Applicants. Our website currently has the ability for people interested in working for Novus or one of our affiliates or subsidiaries to learn more information about employment opportunities at Novus, its affiliates and/or subsidiaries. To apply for open positions using the Novus website, you must create an employment profile through our website (available through the Careers page on our website), which includes the information that Novus requests or requires you to provide to consider your candidacy.

Prior to creating an employment profile, you must affirmatively consent to the privacy terms governing the submission of your Personal Data for employment purposes, which are available in Novus’s HRIS System, UltiPro, and are available when you login using the account information you establish. The terms that you agree to in order to create an employment profile govern Novus’s use of the Personal Data you provide or that is provided to us to apply for employment.

Google reCAPTCHA. We utilize Google reCAPTCHA, which is a free service that protects websites from spam and abuse using advanced risk analysis techniques to tell humans and bots apart. Google reCAPTCHA works differently depending on what version is deployed. For example, you may be asked to check a box indicating that you are not a robot or Google reCAPTCHA may detect abusive traffic without user interaction. Google reCAPTCHA works by transmitting certain types of information to Google, such as the referrer URL, IP address, visitor behavior, operating system information, browser and length of the visit, cookies, and mouse movements. California Privacy Notice

This California Privacy Notice (“California Notice”) supplements the information contained in our Privacy Statement and applies solely to individual residents of the State of California. Pursuant to the California Consumer Privacy Act of 2018 (“CCPA”), Novus International, Inc. and its subsidiaries and affiliates (“Novus,” “we,” “us,” or “our”) provide the following details regarding the categories of personal information that we collect, use, and disclose about California residents.  This CCPA Notice does not apply to our job applicants, employees, contractors, owners, directors, or officers where the personal information we collect about those individuals relates to their current, former, or potential role at Novus. Under the CCPA, “Personal Information” is information that identifies, relates to, or could reasonably be linked with a particular California resident or household. We refer to this as “California Personal Information” throughout this California Notice.

Sources of California Personal Information

We collect California Personal Information from:

  • Our interactions with you, such as through our websites, surveys and questionnaires, emails, social media, and any other online or offline interactions, such as when you contact us via phone or attend one of our events;
  • Our affiliates, publicly available online sources, joint marketing partners, and business partners; and
  • Automatically when you browse or visit our website.

 Categories of California Personal Information we Collect

We collect, and have collected within the preceding 12 months, the following categories of California Personal Information as listed in the CCPA:

  • Category A. Identifiers, such as name, contact information, government-issued ID numbers, IP address and other online identifiers;
  • Category B. Personal information, as defined in the California customer records law, such as name, contact information, signature, payment card number, insurance information, education information, employment information, and government-issued ID numbers;
  • Category C. Characteristics of protected classifications under California or federal law, such as age, sex, and marital status;
  • Category D. Commercial information, such as transaction information and purchase history;
  • Category E. Internet or network activity information, such as browsing history and interactions with our website;
  • Category F. Audio, electronic, visual and similar information, such as call and video recordings;
  • Category G. Professional or employment-related information, such as work history and prior employer;
  • Category H. Inferences drawn from any of the personal information listed above to create a profile/summary about, for example, an individual’s preferences and characteristics; and
  • Sensitive personal information.

Use of California Personal Information

We use these categories of California Personal Information for the purposes of operating, managing, and maintaining our business, providing our products and services, and accomplishing our business purposes and objectives, including using personal information to:

  • Develop, improve, repair, and maintain our products and services;
  • Fulfill your requests and process your transactions;
  • Personalize, advertise, and market our products and services;
  • Conduct research, analytics, and data analysis;
  • Maintain our property and our records, and undertake quality and safety assurance measures;
  • Conduct risk and security control and monitoring, and detect and prevent fraud;
  • Perform identity verification, accounting, audit, and other internal functions, such as internal investigations and record-keeping;
  • Carry out corporate transactions, such as mergers, joint ventures or acquisitions; and
  • Comply with law, legal process, and internal policies, and exercise and defend legal claims.

Information Retention

Novus retains your personal information for as long as reasonably necessary in light of the purpose for which it was collected, consistent with Novus’s data retention policies and procedures.

Disclosure of California Personal Information

We have disclosed the following categories of personal information as listed in the CCPA to third parties for our operational business purposes within the preceding 12 months:

  • Category A. Identifiers, such as name, contact information, government-issued ID numbers, IP address and other online identifiers;
  • Category B. Personal information, as defined in the California customer records law, such as name, contact information, signature, payment card number, insurance information, education information, employment information, and government-issued ID numbers;
  • Category C. Characteristics of protected classifications under California or federal law, such as age, sex, and marital status;

We have disclosed these categories of California Personal Information to: our affiliated entities; trusted third-party service providers; event co-sponsors; joint marketing and other business partners; channel partners; agencies; and third parties in connection with sales or other transactions involving our business.

Under the definitions of “sold” and “shared” in the CCPA, we have “sold” or “shared” the following categories of California Personal Information in the last twelve months:

  • Category A. Identifiers,
  • Category B. Personal information,
  • Category D. Commercial Information, and
  • Category H. Inferences drawn from personal information.

We have “sold” or “shared” California Personal Information to:

  • Network advertisers,
  • Social networking companies,
  • Affiliates, and
  • Analytics providers.

Individual Rights and Requests

If you are a California resident, you have the following rights regarding your California Personal Information:

  • Right to Know. You have the right to know what personal information is being collected about you, including the categories of personal information we collect, the categories of sources from which we collect the personal information, the business or commercial purpose for collecting, selling, or sharing personal information, the categories of third parties to whom we disclose personal information, and the specific pieces of personal information we have collected from or about you.
  • Right to Access. You have the right to request that we disclose the specific pieces of personal information we have collected about you and to the extent it is technically feasible for us to do so, to provide it to you in a structured, commonly used, machine-readable format.
  • Right to Delete. You have the right to instruct us to delete your personal information, subject to certain exceptions.
  • Right to Correct. You have the right to correct inaccurate personal information, taking into account the nature of the personal information and purpose of the processing.
  • Right to Opt-Out of Sales and Sharing of Your Personal Information. To the extent we “sell” or “share” your personal information, you have the right to opt-out of these practices.
  • Right to Limit the Use and Disclosure of Your Sensitive Personal Information. You have the right to limit our use of your sensitive personal information to that which is necessary to perform the services or provide the goods reasonably expected by an average consumer who requests those goods or services, and other purposes permitted by the CCPA.
  • Right not to be Retaliated Against for Exercising Your Rights. We will not discriminate against you for exercising any of your CCPA rights.
  • Right to Appoint a Representative to Exercise Your Rights on Your Behalf. You have the right to appoint an authorized representative with your legal authority to exercise your rights on your behalf, or to exercise the rights afforded to your minor child on their behalf. If you would like to appoint a representative to exercise your rights on your behalf, they must be registered or appointed in accordance with the CCPA.

To make a request for the disclosures or deletion described above, please complete the form below. We will take steps to verify your request before processing your request. We will respond to your request consistent with applicable law. You have the right to be free from unlawful discrimination for exercising your rights under the CCPA.

Shine the Light Law


Under California Civil Code sections 1798.83-1798.84 (California’s “Shine the Light” law), California residents who have an established business relationship with Novus are entitled to ask Novus for a notice describing what categories of personal customer information we share with third parties for their direct marketing purposes.  This notice will identify the categories of information shared with and will include a list of the third parties with which it is shared, along with their names and addresses.  If you are a California resident and would like a copy of this notice, please submit a written request to Novus at the addresses listed below under the Section titled “Contact Information.”

Contact Information
